1. Introduction

These Terms & Conditions (“Terms”) govern your use of the website kitchen-obsession.com (the “Site”) and the purchase of products from Kitchen Obsession, LLC (“we,” “us,” “our”). By using the Site or placing an order, you accept these Terms in full. If you disagree with any part of these Terms, you must not use our Site.

2. Orders & Payment

  • We reserve the right to refuse or cancel any order for any reason.

     

  • Payment must be received before shipment unless otherwise agreed in writing.

     

  • Prices posted on the Site are subject to change without notice.

     

  • Taxes, duties, and shipping/installation charges (if any) are the responsibility of the purchaser unless otherwise stated.

     

3. Shipping & Delivery

  • Shipping costs, delivery times, and installation (if applicable) will be as stated on the product page or during checkout.

     

  • You must inspect products at the time of receipt. Any damage in transit must be reported to us within 24 hours of delivery.

     

  • We are not responsible for delays caused by carriers beyond our control.

     

4. Returns & Refunds (General)

  • Returns and refunds depend on the brand whose product is purchased. We act as a reseller.

     

  • Before returning a product, you must contact us to obtain a Return Authorization (RA).

     

  • Items must be returned in their original condition (unused, undamaged, with original packaging) unless the return is for a defect.

     

  • Refunds will be issued via the original payment method, unless otherwise agreed.

     

  • Shipping or return freight costs are borne by the purchaser unless the brand’s policy states otherwise or the product is defective.

     

5. Brand-Specific Return & Refund Policies

The following policies apply to each brand sold by us. They are drawn from the respective manufacturer’s policy and apply when you purchase that brand from us. If there is any conflict between these Terms and the brand policy, the brand policy controls.

5.1 Big Chill Appliances (Appliances)

  • Standard-color appliances, unused and in box (not installed), may be returned within 10 days of delivery for a refund minus a 20% restocking fee plus return shipping.
  • Custom or premium-color orders (or built-to-order items) are not eligible for cancellation or return after shipment.
  • Order changes: You may cancel without penalty within 48 hours of the order-confirmation email. After that, standard-color cancellations incur a 20% fee; custom/premium color cancellations are not allowed.
  • If the product arrives damaged or defective in transit, you must notify us (and the manufacturer) within 24-72 hours of receipt for repair, replacement or refund eligibility.

5.2 Shun Cutlery (Knives)

  • Items must be returned within 30 days of the order date, unused, in original packaging, for a full refund.
  • Engraved items, warehouse-sale, final-sale or customized products are non-returnable.
  • Return shipping cost is borne by the purchaser.
  • Refunds do not include original delivery fees unless the return is due to defective product, incorrect goods, or mis-description.

5.3 Hestan Cookware (Cookware)

  • Returns may be accepted within 30 days of delivery for refund or exchange.
  • Some sources indicate up to 45 days for a full refund if item is in unused condition and in original packaging.
  • Purchaser pays the cost of shipping returned items unless otherwise noted.

5.4 Smithey Ironware (Cast-Iron Cookware)

  • Returns and exchanges accepted for new and unused cookware within 45 days of delivery.
  • Engraved, marked “Factory Seconds” or “final sale” items are not eligible for return.
  • Refunds issued to original payment method or store credit; shipping fees generally not refunded.

6. Warranties

  • We pass on manufacturer warranties as specified by each brand; we do not provide additional warranty.
    For example: Shun offers a limited lifetime warranty to the original owner.
  • You must register or contact the manufacturer for coverage, if required.
  • Warranty coverage does not replace the return-and-refund process described above.

     

7. Limitation of Liability

  • To the maximum extent permitted by law, our liability for any product is limited to the purchase price paid for that product.

     

  • We are not liable for indirect, incidental or consequential damages (including loss of profit, downtime or installation cost).

     

  • Some jurisdictions do not allow limitation of implied warranties or incidental damages; in such jurisdiction our liability is limited to the extent permitted by law.

     

8. Intellectual Property

  • All content on the Site (text, graphics, logos, images) is owned by Kitchen Obsession, LLC, or used with permission.

     

  • You may not use, copy or distribute our content without prior written permission.

     

9. Governing Law & Dispute Resolution

  • These Terms shall be governed by the laws of the State of Georgia, U.S.A.

     

  • Any dispute arising from or relating to these Terms or your purchase shall be resolved in the state or federal courts located in and for Fannin County, Georgia.

     

  • If any provision is found invalid or unenforceable, that provision shall be severed and the remainder of the Terms will remain in effect.

     

10. Changes to Terms

We may revise these Terms at any time by posting the updated version on the Site with a new “Effective Date.” Your continued use of the Site or continued purchases after such posting constitutes your acceptance of the changes.
